Who is the Visa for?

Temporary workers invited by U.S. employers who demonstrate a need for foreign labor to fill seasonal non-agricultural positions


Eligibility Requirements

A seasonal or temporary job in the U.S. with employer sponsorship, including approved labor certification and a Form I‑129 petition


Visa Duration:

  • Valid up to 1 year, renewable annually

  • Max stay: 3 years, then must leave U.S. before reapplying

  • 2025 rule: 60-day grace period + portability (new job can start once petition is filed)

Processing Time:

  • Regular: ~2–6 months (varies by USCIS & consulate)

  • Premium (Form I-907): 15 calendar days
