THIS AGREEMENT IMPLIES THE IMPLEMENTATION OF INDIVIDUAL ARBITRATION TO SETTLE DISPUTES, IF ANY, BETWEEN YOU AND OPENSPHERE, COMPROMISING THE PROVISION FOR A JURY TRIAL OR COLLECTIVE ACTION. IT IS ESSENTIAL TO CAREFULLY REVIEW SECTION 14, SINCE IT IMPACTS YOUR LEGAL RIGHTS AND WILL CONSEQUENTLY INFLUENCE HOW CONFLICTS BETWEEN YOU AND OPENSPHERE ARE HANDLED.

1. Domain
Domain of Agreement This Terms of Use Agreement (“Agreement”) is mutually entered by you and OpenSphere Inc. ("OpenSphere") and pertains to your utilisation of the website, https://opensphere.ai (inclusive of all subdomains) (the "Site") and the services offered by OpenSphere (the "Services"). By accessing or using the Site or the Services, you consent to abide by this legally binding Agreement. Some OpenSphere Services are also in adherence to additional terms ("Specific Service Terms"), currently accessible here. If there's a conflict between a term in this Agreement and a term in the Specific Service Terms, the Specific Service Terms will govern. Your use of the Site and Services also comply with the terms of the OpenSphere Privacy Policy. Should you purchase Services that include independent attorney review, your association with the independent attorney is under the Attorney Agreement. Disagreeing with the terms of this Agreement and the Privacy Policy means you may not access or use the Site or Services. The Site and Services are for persons aged 18 and above. 2. Service Details; Independence from Government Bodies
OpenSphere offers a platform designed to aid you in filling essential U.S. government forms related to immigration, non-immigrant visas, citizenship, and other associated services, as detailed on OpenSphere Site. We aim to simplify form completions with our guidance and step-by-step instructions. OpenSphere doesn't have any affiliations or endorsements by United States Citizenship and Immigration Services (USCIS), the U.S. Department of State (USDOS), or any other United States government agency. You can obtain all government-required forms from their respective agencies without any charges. Use of the OpenSphere Site and Services is voluntarily and not a requirement for completing and submitting governmental forms.
Government rules, forms, and associated fees are prone to changes. If such a change affects your application after you receive the completed application materials, OpenSphere will provide complimentary updates to your application within 10 business days after your receipt of the application materials.
IN LAYMAN'S TERMS
USCIS supervises various U.S. immigration benefits, and USDOS oversees nonimmigrant visas; both provide all relevant forms for free. OpenSphere is a private entity with no affiliations to USCIS, USDOS, or any other government agency, and the use of OpenSphere's services to fill out government agency forms is not obligatory.

OpenSphere IS NOT A LAW FIRM. THIS SERVICE IS OPERATED BY NON-LAWYERS AND THIS ENTITY DOES NOT FOLLOW THE SAME RULES APPLICABLE TO LAWYERS. ADDITIONAL INFORMATION IS ACCESSIBLE HERE. THEREBY, CERTAIN SERVICES/PROTECTIONS, LIKE ATTORNEY-CLIENT PRIVILEGE, MAY VARY FROM THOSE OFFERED BY A TYPICAL LEGAL FIRM. Purchased Services that include an independent attorney review are governed by an Attorney Agreement.

OpenSphere is not a law firm. If services involving independent attorney reviews are purchased, a distinct Attorney Agreement with that attorney is required to be signed. Account Creation and Appropriate Information
4. Account Creation and Appropriate Information
4.1. OpenSphere Account Creation. Some portions of the Site and Services require creation of an account and setting up a username and password. Ensure the accuracy of the information you share and periodically update it. Impersonation is strictly forbidden. The onus of maintaining your account's safety and confidentiality rests upon you, and unauthorized usage of your account details by anyone is strictly forbidden. For all actions performed under your account, you will be held responsible. Immediately intimate OpenSphere in case of any unauthorized account access. By creating an account, you agree that OpenSphere and its affiliates, could send you electronic communications including offers, newsletters, account notices, and updates. To opt out of such communications, click the dedicated link in the email.
4.2. Your Application. When availing a service from OpenSphere and filing an application, we assign a unique email address to your account, enabling OpenSphere to receive from USCIS, the receipt number associated with your application. Permitting OpenSphere to use this receipt number allows us to intermittently check your application status and share relevant general information about the application process with you. If you prefer that OpenSphere wouldn't retain your receipt number or check your application status, contact our customer service department at connect@opensphere.ai
PLAIN LANGUAGE
Creating an account with OpenSphere might be necessary. Maintain the accuracy of your provided information and refrain from impersonating others. For any action taken under your account, you will be accountable. Upon creating an account, you provide us permission to receive your government receipt number, occasional inspections of your application status, and email communications with offers, newsletters, and general information. To revoke these permissions or unsubscribe from our mails, reach out to us at connect@opensphere.ai
Utilizing Services
5. Accessing and Utilizing Site and Services
5.1. License Granted to You. Grant of a limited, non-exclusive, non-transferable, revocable license to use the Site and Services is subject to your absolute adherence to this Agreement. The license allows access to and use of the Site and Services strictly for your personal, non-commercial use.
5.2. Access and Restrictions. None of the Site’s or Services’ code, content or any of its materials should be used, copied, modified, reproduced, distributed, transmitted, or sold without written consent from OpenSphere. Illicit use or exploitation of the Site and Services is punishable by law. The Site and Services should not be used for any purpose or in any manner that is illegal or fraudulent.
5.3. Changes to Site or Services. OpenSphere reserves the right to modify, suspend or discontinue, at its discretion, any portion of the Site or Services without prior notice.

We grant you a limited license to use the Site and Services for personal, non-commercial use. Do not modify, copy, or distribute any part of the Site and Services without our permission. Use the Site and Services legally. We may change, suspend or stop providing the Site or Services at any time without prior notice.

Termination and Suspension
7. Termination and Suspension
OpenSphere may choose to suspend, limit, or terminate your account or use of the Site or Services, at any time, without prior notice if we suspect that you have not complied with any of the provisions of this Agreement. IN LAYMAN'S TERMS If we suspect that you have violated any part of this Agreement, we may suspend, limit, or terminate your account or use of our services, without prior notice.
Indemnification
8. Indemnification
By agreeing to this Agreement, you accept to indemnify, defend, and hold harmless OpenSphere, its officers, directors, employees, agents, and third parties, against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses.
LAYMAN'S LANGUAGE
You agree to protect OpenSphere and its affiliates from any claims, damages, or legal judgements if you violate this Agreement.
