What Is the EB-1A Green Card?
The EB-1A is an employment-based first preference green card for individuals with extraordinary ability. It is the highest tier of employment-based immigration and provides permanent residency in the United States.
Unlike most green card categories, the EB-1A allows self-petitioning — you do not need an employer sponsor or a labor certification (PERM). This makes it uniquely attractive for founders, researchers, and independent professionals.
Quick Answer
The EB-1A green card grants permanent residency to individuals with extraordinary ability. You can self-petition without an employer, skip the labor certification, and often receive approval faster than other green card categories. You must meet at least 3 of 10 evidentiary criteria.
The 10 EB-1A Criteria
USCIS evaluates EB-1A petitions against ten evidentiary criteria. You must satisfy at least three:
1. Awards — Nationally or internationally recognized prizes for excellence
2. Membership — In associations requiring outstanding achievement
3. Published Material — Press coverage about you and your work
4. Judging — Serving as a judge of others' work in your field
5. Original Contributions — Of major significance to the field
6. Scholarly Articles — Authorship in professional or major media
7. Exhibitions / Showcases — Display of work at artistic exhibitions or showcases
8. Leading / Critical Role — At distinguished organizations
9. High Salary — Commanding high remuneration relative to peers
10. Commercial Success — In the performing arts, evidenced by box office or sales

Phase 1: Prepare and file Form I-140 (Immigrant Petition) with USCIS, including all supporting evidence and a detailed petition letter.
Phase 2: Once I-140 is approved and your priority date is current, file Form I-485 (Adjustment of Status) if you are in the U.S., or pursue consular processing abroad.
Phase 3: Attend biometrics appointment and interview (if required). Receive your green card upon approval.
