Refugee Visa
The Refugee Program provides humanitarian protection for individuals outside the United States who are unable to return to their home country due to persecution or a well-founded fear of persecution. Unlike asylum (filed inside the U.S.), refugee status is processed through the U.S. Refugee Admissions Program (USRAP) overseas. Successful applicants are admitted to the U.S. as refugees with a direct path to permanent residence.
Individuals outside their home country who cannot safely return because of persecution based on:
Race
Religion
Nationality
Political opinion
Membership in a particular social group
Must be referred to the U.S. Refugee Admissions Program (USRAP) by UNHCR, a U.S. embassy, or a designated NGO.
Must pass a Refugee Status Interview conducted by U.S. Citizenship and Immigration Services (USCIS) officers overseas.
Must clear extensive security, background, and medical checks.
Cannot have resettled in another safe third country.
Must not be barred (e.g., persecuted others, engaged in terrorism, committed serious crimes).
Processing Time
Varies widely due to extensive vetting; typically months to years depending on country, security checks, and resettlement priorities.
Visa Duration
No set expiration – refugee status is indefinite.
Green card eligible after 1 year of physical presence in the U.S. (must apply for permanent residency).
Citizenship eligible after 5 years as a green card holder.
Status may be revoked if conditions change or eligibility is lost.
