Less Evidence, Better Proved: A Marketing Director’s O-1A, Approved After RFE
Less Evidence, Better Proved: A Marketing Director’s O-1A, Approved After RFE
An O-1A approval for a growth and digital marketing leader who built the customer acquisition function at three companies on two continents, most recently a venture backed home services marketplace. The RFE accepted one criterion and found three insufficient, each for the same reason: the letters described his impact, and nothing in the record measured it. We dropped the weakest criterion, narrowed the published material claim to a single article, and replaced every adjective with a document: certified org charts, payment processor sales reports, signed contracts, bank records, and a letter from a colleague who no longer works with him. Approved three weeks after the response was filed.

Case Background
Case Background
The O-1A is for individuals with extraordinary ability who have sustained national or international acclaim. Most cases are proven by meeting at least three of eight regulatory criteria, followed by a final look at the record as a whole. Here is the case:
A marketing and business development professional whose career is one discipline pursued at three companies: building the commercial function through which a business turns demand into revenue
Sole owner of customer acquisition at a venture backed home services marketplace, where he also conceived a new advertising business built into the company's inspection reports
Earlier, the first commercial hire at a marketing technology startup and a top performing new business representative at a division of a publicly listed travel group
Original filing presented five criteria: critical role, published material, judging, memberships, and original contributions
Filed in mid August under premium processing. The RFE arrived four weeks later

What the RFE Said
What the RFE Said
The RFE found judging met. On the other four criteria, its reasoning followed one pattern: the record asserted significance without proving it.
Critical role: letters without numbers. It said the letters described his work but gave no corroborating evidence of "the size of the increase in profits, market share, etc." or the extent to which his individual contributions were responsible for each company's success.
Published material: the wrong yardstick. Five articles had been filed with web traffic rankings. The RFE looked at the global rankings and concluded the publications did not qualify as major media.
Original contributions: no proof of adoption. It acknowledged the two advertiser letters describing his marketplace but found nothing showing the work was being implemented by others, had provoked commentary, or was licensed or used by others.
Memberships: networking groups, not selective associations. It said nothing in the record showed admission depended on outstanding achievement rather than an application and a fee.

Our Strategy
Our Strategy
Bank the conceded criterion and do not touch it. Judging was met. We said so in one sentence and reserved that evidence for the final merits review.
Drop what cannot be fixed. The membership organizations were what the RFE said they were. Rather than argue, we withdrew the criterion and concentrated on the three that could be proven.
Narrow before strengthening. Five articles had been filed. We rested the published material criterion on one, and proved that one completely.
Correct the standard where the RFE got it wrong. The regulation names three kinds of publication and the Policy Manual measures each differently. The RFE had applied the major media test to a trade publication.
Replace every claim with a record. For each company, a certified org chart, a document created at the time rather than for the petition, and a number from a source the company does not control.

How We Answered
How We Answered
Critical Role: Structure, Then Numbers, Then Causation
For each of the three organizations, we filed an org chart certified by the CEO or his direct supervisor showing that the company's revenue entered through his position and no other. At the current company, the chart recorded that he owned every customer acquisition channel and that no parallel marketing function existed. Then came the numbers the RFE asked for, drawn from the company's payment processor rather than from a letter: sales began the month after he joined, monthly sales grew nearly tenfold over the following year, and first half sales for the current year were almost double the whole of the prior year. The CEO's letter closed the loop by stating in plain terms that no one else had held responsibility for the function that produced those results.
For the earlier companies, the strongest documents were the ones nobody wrote for the petition. An email from the startup's CEO, sent years before the filing, told him he had taken full responsibility for the company's sales in his country and was already a critical part of the company. For the travel group, a former senior colleague who has since left the organization and has no ongoing relationship with him independently confirmed the largest account he originated, matching his supervisor's account in every detail.
Published Material: One Article, Three Categories
The regulation lists professional publications, major trade publications, and major media as separate categories, and the Policy Manual assesses them by different factors: intended audience for professional publications, relative circulation within the field for trade publications, and absolute reach for major media. The RFE had measured a startup trade publication against the entire internet. We offered the article as published in a professional publication and, in the alternative, a major trade publication. Two independent publications in the same industry, neither connected to the article or to him, listed it among the established startup media in its region. Its industry rank, already in the record, was the highest of any publication the RFE had reviewed. The other four articles were not argued.
Original Contributions: Contracts, Not Testimonials
The RFE named the evidence it wanted: contracts with companies using the beneficiary's product, and letters from investors describing the significance of his work. We filed both. Signed agreements with independent service companies across six states, two of them predating the filing, showed other businesses adopting his marketplace model and paying a share of each job won through it. The contracts themselves defined the model in binding terms, which answered originality better than any description could. An investor who had founded and publicly listed a technology company explained in his own letter that the model was the main reason for his investment, and the signed investment agreement and bank records documented the capital. Letters from the advertisers already in the record were placed in that context rather than re-argued.

The Outcome
The Outcome
Approved, three weeks after the response was filed.
The original petition claimed five criteria. The response argued three, one of which rested on a single article, and the case was stronger for it. An officer who reads a stack of articles with weak rankings forms a view of the whole stack. An officer who reads one article with two independent sources vouching for the publication has nothing to discount. The same logic held across the response: fewer claims, each one closed with a document the petitioner did not write.

What O-1A Applicants Can Take From This Case
What O-1A Applicants Can Take From This Case
A criterion the RFE marks as met is banked. Say so once and move on.
If a criterion cannot be fixed, drop it. Arguing a weak criterion costs credibility on the strong ones.
Fewer, better. One article proven fully beats five articles proven partially.
Check which standard the RFE applied. Professional publications, trade publications, and major media are measured differently, and the Policy Manual says how.
For critical role, give the officer three things in order: an org chart showing where revenue enters, a number from a source the company does not control, and a letter that says no one else held the function.
The best letter is one written before the petition existed. Old emails, performance reviews, and investor updates carry weight that a letter written for USCIS cannot.
A former colleague with no ongoing relationship is worth more than a current one. Independence is evidence.
For original contributions in business, contracts are the proof of adoption. If other companies are paying to use your work, file the agreements.
