Software Engineer, Filed as an Engineer: A TN Approved
Software Engineer, Filed as an Engineer: A TN Approved
A TN approval for a Canadian software engineer joining a venture backed US startup. Software engineering is one of the most common TN requests and one of the most commonly questioned, because the USMCA list says "Engineer," not "Software Engineer," and officers do not always accept that writing software is engineering. The work here was proving that this role, and this candidate, sit squarely inside the Engineer profession. Approved under premium processing.

Case Background
Case Background
The TN is a treaty based work category for Canadian and Mexican citizens under the USMCA, the agreement that replaced NAFTA. There is no lottery and no annual cap, which makes it fast, but eligibility depends entirely on fitting a listed profession. Here is the case:
A Canadian citizen, outside the United States, who would use the approval notice to enter at the border without needing a visa
Hired by a US software company to design and build the core systems behind its automation platform
Holder of an accredited bachelor's degree in software engineering, graduated with top honours
Prior full time engineering experience at a major Canadian technology company, plus work for the employer from Canada
Category: Engineer, under the USMCA professional list

The One Thing That Mattered
The One Thing That Mattered
The Engineer category requires a bachelor's degree or a state or provincial license. On paper that looks easy for a software engineer. In practice, it is where many of these cases run into trouble.
The question an officer asks is whether the role is real engineering or just programming. Computer Programmer is not on the USMCA list. So a software role described in everyday tech language, with a degree that reads like a general computing degree, can look like a programmer job wearing an engineer's title. That is how software TNs get questioned or refused, even when the person is fully qualified.
The answer is a straight line: the degree, the listed profession, and the actual job duties all pointing to the same place, with no gap anywhere.

How We Did It
How We Did It
We built the case on the strength of the degree first. The beneficiary's bachelor's in software engineering comes from a program accredited by the Canadian Engineering Accreditation Board, the same accreditation that forms the academic path to licensure as a Professional Engineer in Canada. That made it an engineering degree in the formal sense, not a computing degree with an engineering label. And because it was earned in Canada, no separate credentials evaluation was needed.
We then documented the position as engineering work. Rather than a list of coding tasks, the duties were set out as applying engineering principles, computer science, and mathematical analysis to research, design, develop, and test the company's systems: architecting the platform, writing technical specifications and performance requirements, engineering the runtime at the operating system and virtual machine layer, and directing testing and validation. We tied the role to its recognized occupational classification as well, so the engineering nature of the job was supported by an outside reference and not just the employer's word.
Finally, we lined up his professional history, full time systems level engineering work and time already spent on the employer's platform, so his experience reinforced the same picture.
We also covered the TN's other requirements: that the role is a genuine employment relationship rather than self employment, and that the stay is temporary, with a defined end date and no intent to settle permanently.

The Outcome
The Outcome
Approved under premium processing. The company secured a key engineering hire without delay, and the beneficiary can now enter the United States in TN status and continue the work he was already doing for the team.
Software engineer TNs are approved every day, and they are refused every day too. The difference is rarely the candidate. It is whether the filing shows, clearly and from every angle, that the job is engineering and the degree is an engineering degree.
